Howdy folks this is the August issue we got some great stories from my Australian walkabout and we still have September due where I have yet more Ozzy years before I am off to the USA to visit a little bit of gold mining and wild west history and cover the elections in November before I head to New York then Scotland for some more under the headline sleuthing,

Both airlines would feature in journalist Rod Vaughans, who passed away last weeks in his initial TVNZ investigation into these Sky based gun runners. To paraphrase the Russian pilots in the documentary Darwin’s Nightmare ‘we fly oranges to Europe, so children can have fresh fruit on Christmas day, on the same planes we use to bring in land mines and bombs that cripple the children of Africa’, where wars are fought to supply the first world with its wants funded with resources, that the developing world needs to survive, siphoned off at the expense of these impoverished nations.

The Cairn aircraft, a known regular visitor since 2018 and is listed as call sign UR82027

UR82027 is recorded as delivering Turkish military export using airport tied to the Azerbaijani Laundromat (see Paradise Papers) , which has seen Russian gas sold to Turkey who in turn has provided Israeli weapons (including Israeli and NZ drones to Islamic extremist and Azerbaijani oil dictators). Money washed through NZ Australian banks via tax havens in the Pacific such as Niue, Vanuatu and the Cook Islands.

It listed as part of the Ukraine Alliance the plane tagged with the legends Be Brave Like Kharkiv. Canberra Airport also hosted “Be Brave Like Bucha” in January 2023 last year.

Update: The appearance of the UR82027 and an apparent surge in security concerns comes as the Australia n government has insinuated Palestinian refugees at anti-Israeli rallies are linked to Hamas. Again, no evidence is offered with this claim made under parliamentary privilege.

his brings back memory of the MV Rhosus a general cargo ship abandoned in Beirut, Lebanon, carrying 2,750 tones of ammonium nitrate that contributed to the catastrophic 2020 Beirut explosion. The vessel’s owner at the time of abandonment was Cyprus-based Russian businessman Igor Grechushkin. The ship sank in the Port of Beirut in 2018. The vessel like the aircraft is part of network on Ukrainian-Russian/Israeli interest using offshore banking to lease aircraft and ships often used for nefarious purposes including the breach of UN arms embargoes or international sanctions.

Update I found UR-8027 also delivered a damaged Ukranian M903 launcher, part of the Patriot SAM system, to the United States in April 2024.

This recent visit all coincides as more than 50,000 protesters are expected to protest against Israel at a Melbourne arms expo on September 11 2024.

Last week many of the upcoming participants, including its believed representatives of Thale Bendigo, attended a tank display at Smithfield in Cairns. That be the tank factory that is preparing to send large quantity of armored vehicles to the Ukraine and escalate cold war tensions.

Missing Billionaire…their a hole & it not just in the yacth.

To make quite clear just the billionaires who died in the Titanic submarine accident I have no idea how they died I was not there. How-ever their death and the death of other AI and Crypto engineer’s deaths have put the spotlight on some pretty amazing technology which has the power to alter society in some fairly major ways. It also put the spotlight on the fact there are some majorly shady people involved in the financing of this technology and raises the question should we not be concerned that so many unsavory types with some very unsavory histories are involved in technology which if not involved in a transparent manner has the means to serious disrupt the democratic process?

One of the firms which Mike Lynch, the billionaire drowned on his luxury yacht last month in italy, owned was Darktrace. The company was founded in 2013 in Cambridge. It was founded by mathematicians and cyber defense experts.

And aside from it ties to the spooks there was criticism about the company’s technology and and founding investor by short-seller Matthew Earl, head of the Shadowfall fund, and analysts Peel Hunt. In January 2022, Earl questioned Darktrace’s model and culture, warning clients that the company’s model was “watery-thin”, based more on sales style than business substance. In March 2022, Darktrace acquired Cybersprint, a Dutch attack surface management company, for €47.5 million. The company’s share price promptly fell 12 per cent when Quintessential first disclosed its short position on 30 January 2023. The shares then fell a further 8 per cent the following day, after the report was published. On 18 July 2023, EY concluded its review into the company’s contracts and internal financial processes. EY found a “small number of errors and inconsistencies” with some of the contracts but nothing that would be “material” to Darktrace’s financial statements. Lynch however was then charged with 16 counts of wire fraud, securities fraud and conspiracy by the US authorities, who claim that Hewlett-Packard’s troubled acquisition of Lynch’s Autonomy was built on lies. Miraculously he beat the rap and his last boat trip was to celebrate this fact.

Tech Billionaires Keep Dropping.

Lynch is not alone.

Lynch death proceeds the death of his partner Stephen Chamberlain, 52. Chamberlain was struck by a car just days before Lynch and five others went and celebrated on the luxury superyacht which sank off the coast of Italy.

Lynch co-founded Darktrace with Chamberlain in partnership with former U.K. intelligence officials in 2013. For example, one of the co-founders was Stephen Huxter, a high-ranking figure in MI5’s cyber defense team, who became a managing director at Darktrace. Former head of MI5 Jonathan Evans also sat on the Darktrace’s board for a time, while Jim Penrose, a 17-year veteran of the U.S.’s National Security Agency, formerly headed up the company’s American operations. Other former spooks at the company included director of technology Dave Palmer, who previously worked at MI5 and GCHQ, and director of security John Richardson, who worked on cyber defence for the UK government. The Cambridge-based company fights cyberattacks used software that learns the behavioral patterns of every actor within an organization and detects unusual behavior. Lynch’s connections with the murky sphere of intelligence predated Darktrace. His first company Cambridge Neurodynamics, which specialized in computer-based fingerprint recognition, held contracts with the U.K. intelligence agencies. “They have the most interesting problems,” he told Wired magazine in 2002. Details are beginning to emerge how spymaster in both the UK and USA ignored the risk posed to supply by cyber hacking despite knowing the risk due such technologies as Dark trace and palo Alo which includes former New Zealand Prime Minister John Keys who own role in inside trading investigation has largely been under reported here in New Zealand,

Lynch other defence links include Autonomy formed out of Neurodynamics in 1996. The company, which Chamberlain joined in 2005, used machine learning to analyze data from sources such as intercepted phone calls and emails. Autonomy also scored high-profile tenders from U.K. and U.S. government agencies, including a contract to provide infrastructure to the U.S. Office of Homeland Security to analyze intelligence as part of the war on terrorism following 9/11. A 2003 Guardian article described the company as “dealing with secret intelligence” and “among the few UK commercial organizations that stand to profit from the Iraq war.” It described the company’s technology as “advanced computer eavesdropping systems.”

At that time, the company held other contracts with U.S. government agencies including the army, NASA, and US intelligence agencies. GCHQ and MI6 were also believed to be clients. Richard Perle, a former Pentagon appointee, who served as chair of the Pentagon’s defense advisory board, acted as one of the company’s directors.

The company’s chief financial officer, Sushovan Hussain, was additionally convicted of fraud in 2018 and later sentenced to five years in prison. However, Lynch unexpectedly escaped conviction on the basis that he focused on the company’s tech and had little knowledge of its finances. He put his escape down to being wealthy enough to afford the legal fees involved in fighting the case in the U.S. courts. He was represented by the same defense lawyer as the disgraced late pedophile and investor in quantum surveillance Technolgy Jeffrey Epstein.

Epstein who died in prison likewise held intelligence connections related to surveillance eves dropping and blackmail as did Defacto father Robert Maxwell who died after he fell off his yatch in 1991. At the time Maxwell was involved in the sale of Promis which in many ways the grandy daddy of many of the system been discussed in this article. Billionaire Fabrizio Longo, the head of luxury carmaker Audi’s Italy business, died in a tragic mountain climbing accident near the Italian-Swiss border. According to the New York Post, the top Audi boss, an avid mountain climber, fell 10,000 feet while climbing the Cima Payer in the Adamello mountains. Audi own AI program is extensive including using AI as a risk radar: an early warning system which analyzes publicly available sources in more than 50 languages for sustainability risks in the supply chain. Billionaire Angela Chao was pronounced dead in 2023 after she her Tesla reversed into a pond on a private ranch in Texas. Angela Chao was initially termed as an accident but is now ruled a “criminal investigation,” according to the Texas sheriff’s office.

A prominent Texas-based CEO  nd sister-in-law of US senator Mitch McConnell allied to the connor family. Angela Chao was a graduate of Harvard University and published several books on economics, international trade, and finance. Her sister Elaine Chao was the transportation secretary under former US president Donald Trump. She is survived by her husband Jim Breyer, a venture capitalist. Chao was single handily responsible for the supply chain chaos that led to spiking inflation, and with it, became the Democrats’ greatest political liability as Biden kept her on. She is widely dubbed “the personification of the corruption of the modern Republican Party and actively made ordinary Americans’ lives worse”.

Her father James Chao is the founder of Foremost Group. Foremost is a nominally American shipping and logistic company, which does most of its business in China and sails under the flags of Liberia and Hong Kong. Its presence in the US is minimal, with only a small, unlisted headquarters in Manhattan. In 2014 Gain Capital Group, the largest retail FX broker in the United States, was ordered to pay a civil penalty of $300,000 to resolve CFTC’s allegations over its handling of customer accounts introduced by Illinois broker, Mark Miller and his investment firm, Foremost Trading. The 45-year-old Mark Miller, is the last of three men to be sentenced for the securities fraud scheme, which became public through an indictment filed in June 2021 in U.S. District Court in Minneapolis.

December 2023 Sense Time ceo Tang Xiaoou, billionaire, information engineering and professor at the Chinese University of Hong Kong, died of an unspecified illness. Before his death his SenseTime was attacked by a short seller. U.S.-based Grizzly Research said in a November report that the company was inflating revenues through a scheme called round-tripping, where it allegedly paid other companies to purchase products from SenseTime. The AI company said in a filing to the Hong Kong stock exchange that the report was “without merit and contains unfounded allegations and misleading conclusions and interpretations.” Its stock has plunged more than 40% so far this year, and almost 80% since its IPO.

June 2023 Dubai based Hamish Harding: Billionaire adventurer who was killed on board Titanic submarine. June 2023. Harding was CEO of Aviation Action involved in using AI used for geophysical mapping and AI tech used to conduct land grabs.

Billionaire Shahzada Dawood and his son Suleman were also killed on board Titanic submarine.

Dawood served as vice-chairman of fertilizer company Engro Corporation a subsidiary of the Dawood Hercules Corporation, all part of the Dawood Group founded by Shahzada’s paternal grandfather Ahmed Dawood, who was born in Gujarat. Dawood Group of companies wound down its insurance company – Central Insurance – and restructured it to become Cyan Ltd, a company that invest in high growth sectors in Pakistan and has agriculture as one of its priority sectors as investment companies gear towards extracting high yields from the agriculture sector in one of the largest land grabs in modern history.

Empiric AI, founded in June 2020, develops Industrial Internet of Things (IIoT) and Artificial intelligence for the industrial sector. In October 6, 2022, the Board of Directors of Avanceon Limited approved the acquisition of Empiric AI (Pvt) Limited, a wholly owned subsidiary of Dawood Hercules Corporation Limited (DHCL), under a share swap agreement. Under the arrangement, the publicly listed Dawood Hercules Corporation will get a certain percentage of shares in Octopus Digital Limited, a Microsoft partner, who currently owned 80% by Avanceon which is also listed on the PSX, and 20% by public shareholders.

Ahmed was linked to rogue Dubai Pakistan Saudi bank BCCI and Pakistan nuclear weapon program. BCCI funded terrorism organized crime as well as stealing high tech weapons and mass surveillance technology such as mass surveillance anti money laundering tool PROMIS.

Now people do die be they rich and poor. But it’s also a truism that when 8 billionaires die ( 7 within 12 months of each other), who are all involved in AI, all with specific interest in supply and quantum data-forecasting, many also with ties to the defense sector and dubious financing scheme, then the odds do form a mathematical anomaly. And as it continues to gets larger (and I have not even covered the crypto billionaire deaths) if you’re not wondering what’s behind their demise then you should at least be asking what up with supply. And as for the lack of transparency surrounding what this technology is being used for or has the potential to do that speaks for itself.

Respite I continue to have a home in The Magic Forest when explain to Action Smith my not wanting to move after all the effort put in. Good news then Kezo rings she at the hospital she had a suspected heart attack. Hours later it emerges she okay and doctor diagnose it as an anxiety attack. Fair call seems some days these days as if living just one constant anxiety attack.

Gold continues to plunge along with it my wee nest egg & research/travel fund. At least my money in the banks safe….so far at any rate.

Speaking of bastards begin the day by reading a few pages of Thatcher’s Gold and Iearn Mark Thatcher aka Milk Snatcher (a name he earned after his mother Margaret scrapped free milk for kids at school in the UK ) worked for my ‘cuzzys’ Jardine Mathieson and their South African subsidiary Rennies.

Oddly however the social climbing Mark, very much a product of the UK snobby public schools*, would not follow Cecil Rhodes path and use the prestigious University to network. Largely so it appears because Mark was deemed academically to be a total dunce – Though to the astonishment of his follow Harrows classmates Oxford did offer the son of rising Tory politician a place.

*1 An oddity of England a private school is called a public school and a public school is known as a grammar school. A public school was a world of “Fags”( a curious term), school ties, tea and hot buttered crumpets. And if you believe the gist of Tom Brown School Days hot buttered crumpets shoved up Fags bottoms.

Not so much a brotherhood of true friendship but Lord of Flies induced collective terror where ”loyalty’ meant not getting the snot beaten out of you by never deviating too far from the line. A Fag in this context is a junior pupil who by institualised bullying known as ” tradition” was expected to serve and do errands for senior pupils. Though I suspect in the tester-one fueled boys only world, where systematic sadism and deviant bullying was none to subtly encouraged by the system it self that yes it probably has a connection to the derogatory slang terminology we now associate with that word to mean today.

The word South Africa reminds me of a minor bug bear on two fronts.

The first is I have conflicting accounts on whether Moonlight ever spent time in South Africa mum’s records make no account. However, the New Zealand Archive online Encyclopedia Te-Ara suggest otherwise but has provides no examples and has several incorrect assertions picked up from parochial amateur historians’ sources. There little to suggest other than probable port call at Cape town that he spent any real time there as a miner and so combined with the researchers’ double evils of lack of time and money South Africa won’t be going on the travel itenary sadly.

• The local historian hobbyist is both a source of exquisite gems based on deep passionate local knowledge and dually often the origin if flawed pyrolite like assumptions. As the sleuth lacking any real knowledge beyond their pond often simply settle for often deeply flawed assertions in place of facts.

Which brings me to the second and more irksome issue raising it head when I plotted the first league of my field trip pilgrimage of Bativa aka Indonesia.

Several authors often assert Moonlight title of Captain was honorific and self-appointed. This blatantly ignores his pre prospecting history as a mariner working his passage to America (;via South Africa) and that he had worked coastal cutters in the USA when arriving and after that captained the Warick trading and traveling the Spice Rout in between prospecting in Australia and New Zealand in

On the later point of who exactly was in Moonlights Spice adventures I will need to confer with mums Moonlight Diaries which I have abridged into A-Z workbook which I will take with me for reference when i hit the road (9days and im suitably panicking).

On the Australian league I had thought of crossing from Cape York to Indonesia.

That is until I got a visual fix from my work desk globe. Hmmm just a little tad Too far*. I might possibly be able to fit it on the way back.

There are at times when traveling the issue of converting the fact that what on three fingers away on a 2d paper map is in reality several thousand miles of mass fill of mountains rivers delayed flights, uncooperative border officials, mercenary taxi drivers, non-synchronized train time tables, unpredictable livestock, wild animals, foreign languages and in my case a talent for forgetting bags and dsylexically misreading when stressed appointment times — what could possibly go wrong I say ignoring the current sweepstake running on whether it my phone camera or passport that l loose first.

Again, time and money will dictate what I can do regardless of my infinite bucket list to see it all. Oh, for a just a sliver of Thatcher’s Gold.

Retrospectively I wish i had booked a couple of extra days to make the journey over the Torre Straits to PNG where firms like Barrick Gold feature large in the story of corporate globalism along with the likes of British SAS Colonel Tim Spicer whose South African Executive Outcome in many ways mirror the wot wot Harrowvian Rhodes colonial misadventures of Saladin Holdings. The later of whom Mark Thatcher had dealings having been introduced by Thatcher adviser David Hart the man who bank rolled the scab miners who worked during the UK miners strike of 84-85.

A time in history when the UK suffered due to due twin imports from Aotearoa namely The New Zealand Experiment* ( aka the roll out of Chicago [ Al Capone Town] School of Economics style Neo liberalism) and Tom Thatcher father of Denis Thatcher whose money from his firm Atlas Preservatives largely bank rolled Margret the daughter of a methodism green Grocers rise up the social and economic ladder of Tory politics.

• When looking at the name Atlas I paused to wonder if that had old school connotations a paragraph down in Thatcher’s Gold I learn Tom Thatcher was both a Freemason and devotee of The Kipling society which like Kitchner Milne society, the Fabian Society, and The Rhodes Scholarship and its modern offshoot The Atalas Network where all tools of promoting the brotherhood of men as long as the men had title land money an Oxford Cambridge degree ( replace with Ivy league if American) or preferably all of the above.

It would be the ruthless handling of the Miners’ Strike that had earned Thatcher her monologue the ‘Iron Lady’ as with deep pockets and a bagful of dirty politics she had broken up the miners and set her teeth into the notion of workers solidarity.

Solidarity.

A notion which in many ways has been another import from New Zealand courtesy of the Blackball Strike (near Moonlights Creek ) of 1905.

Though of course the reverse colonialism of workers’ rights born out of The Blackball miners’ strike where red tunics and socialist ideas of the brotherhood of working men had in turn made its journey to New Zealand via the convoluted and not necessarily in chronological paths of Eureka barricades of Ballarat, the Bendigo and Palmer River gold rushes of Australia, the Diamond fields of Kimberly, California 1849s and the red shirted Garibaldi movement. Along the way it had fired pistols, crossed swords or alternatively shared a pipe or a pint with the likes of Mark Twain Rodger Kipling and of course Cecil Rhodes, Milnes and Lord Kitchner.

However, like South Africa and probably Indonesia money and my time frame of 80 days ( a nod too Jules Verne) will mean I will have to settle for an itenary that follows the course

Of Wellington to Melbourne to Ballarat and Bendigo. Bendigo to Brisbane where I must visit my great grandparents Cemetry then fly to Cairns. From Cairn it off to Cape York vis Horn Island to explore my Vidgen Jardine roots before dashing back to Cairn for a there and back blat to Cooktown by bus. Then back home to deliver my papers around NZ South Island as I simultaneously visit Moonlights haunts. Then it back on the plane here welcome Argentina Bolivia Panama Mexico. And assuming the CIA says it okay I will cross the border legally and make my way to Sacramento care of the Santa Fe gold trails a land whiskey, gold silver dollars, pistalerios and buckeroos ( as Lenny would say). From California we set off to fund a bit more about George’s cousin Thomas Moonlight and a world which commonly featured such names as Jessy James Butch Cassidy Wyatt Earp (my inner Lenny very excited about that bit) as I traverse Wyomy Kansas and West Virgina.

All going well, assuming I have not been waylaid by bandits (from either the private or public sectors) will be in Washinton DC November 5th for the start of possibly the second Civil War. That is before attending the wake/celebration at an Irish bar somewhere in Barney Town (NY).

From NY it a plane ride from JFK to Scotland and we hit the home straight of Moonlight birth origins at St Vigeans.

Then it will be time to come home via Portsmouth Wales London Cornwall and Amsterdam where i go to explore The Black Rock Vanguard template of uber capitalism the Dutch East Indies Company and then make my home by the slowest boat my remaining time and money can muster or musket.

And all I have to do to make this possible is not lose my phone, passport, camera, tickets, or my mind.

On that note I pray for advice and guidance from the saint of traveler’s food booze and explorers “Saint” Anthony Bourdain who advise that a ruined trip is one where you try to see it all and there for are so busy rushing around you never stop to Savoury anything.

Last night talking at the Pub to guy just returned from NY I’m made acutely aware of just how vast and fast Time Square and likewise the whole of NY America is.

I am but ant crawling across a giant melon. If I’m being honest I’m a little terrified by the task i have sit myself.

Yet Ant says its okay, stay cool Kid. Be polite, be professional and have a plan to kill everyone in the room. No wait thats Bond. Regardless the vibes right.

Take your time, allow yourself to pause and regroup so at each gentle dance step you recon prepare and plan. Of course, a plan is simply temptation to the gods a source of vast amusement and enjoyment. Nothing makes a deity happier than messing with a plan.

Time to get up and check Kezo Okay and the markets hasnt wiped me out. Which to the pious part of me lectures would be fair Karma in light of post Sam Creek i have far more in-depth knowledge of how truly poisonous this yellow metal is. Yeah, will i kind of knew that already Sherlock I retort having study history and politics for the past 40 years.

I justify it for the mean time as the best tool for studying anything is to live it. And by living it can you truly see through the eyes of another.

I need to go even briefly where moon light went and when mum and Lenney came from if I’m to pull this off.

In the first book we plot the journey to now, explaining the how’s and why. In the last we will let mum do the story telling of Moonlights journey and i will simply supply the foot notes and bibliography.

In this book we go into the field to give that journey context. Both from a then and now perspective but also to aid in the process of flushing out the raw data to provide additional accuracy and authentication to mums work which has already been sourced repeatedly by academic and historians as solid in New Zealand America and Japan.

Nether mum or Len were just facts people, and neither am I. Along the way I want to share great food and art with you. I want you to roar with laughter and occasionally cry tears. I want racetracks and cannon fire music and sea spray. I want your knuckles white with terror and your hair standing on its end. There will be bloodshed there will be sweat spit and cum. It won’t be tidy, but it may be pretty. Even at times by pretty I mean pretty messy.

TIME FOR A NEW LOOK

Since putting that conversation out in the universe – so to speak – there has been a definite shift in energy toward me. Not that everyone heard the conversation, but just that it was out in the world, no longer simply emanating from me, but from others picking up what Im laying down. lol

For instance a Foreign owner of significant land here, who at one time I had tried to sell on the idea of luxury Tiny homes to avoid the cost and regulatory hurdles of permanent building, but was met with eye rolls, has just come back to me after years of silence – asking if I think there might be a market for them here – for sale on his land. 

His turnaround tells me there is hope for an affordable housing solution coming soon, based on home ownership separate from land ownership, relocatable homes on homesites to rent, will be accepted as the new first step on the housing ladder – or the last step in an independently owned retirement option. 

The benefit being, increased location flexibility and ownership security for homeowners – move it before you lose it, to a flood or a failing real estate market. Save up buy land and move it. Sell land – move house to leased land, pocket the capital for retirement. All kinds of new possibilities.

The Risk? And a likely one. That powerful entities and corporations (Black Rock) buy up all the land in their bid for global resource control.

Im hoping our Waitangi Treaty will avoid that for us.

Tricky times. 

Another reason to consider my idea of dissolving Central Banking and adopting Sovereign Currency paid to the population without condition in the same amount. (Pegged annually to the Cost of Living – to cap markets. Cost of Living posted to Public Portal for annual Budget approval by the people.

But this time instead of the Government keeping all the money in easy to steal bags labeled “Pensions”, “Kiwisaver”, ” Infrastructure Development Fund” and Government “Social Services”,- Meeting Public education, Health and safety regulations dictated by “Liability Insurance”.

This time the people have the money – people who have always had money remain empowered, with additional capital to invest or spend into the economy. 

“Authentic Human activity” v “Administered Human activity.

The vast majority of people who just want to sustain themselves, 

“Work” paid or unpaid – is simply how time is spent by any individual.

Time is the definitive equalizer for humans.

We each have 24 hours in a day TO SPEND 

The economy is based on how much of other people’s TIME  businesses can purchase for the lowest cost.

THE COST OF LIVING – A LIVING WAGE? 

Human Currency is our Time – Human Energy, Intelligence, Empathy, Enterprise, is essential to sustaining life and living well and in peace.

How we choose to spend OUR TIME is our Humanity and the Economy, 

The vast majority of Humans want to Spend TIME with their loved ones and spend TIME doing the “work” activity they are drawn to do.

With regular recurring income, the population is empowered. Free to follow their authentic interests, talents and aspirations, and free to solve their own financial challenges – because they have a secure income – a LIFE/TIME payment – always enough to meet the basic cost of living.

Co Governance An Explanation

My questions to Professor Vowles are as follows.

1. There are generally 2 camps regarding Co governance.

A gainst it and anti Treaty/ For it for equal representation of Maori soverignity.

Im however interest in the third group you raise The against it if it undermines article 2 of the Tiriti.

Can you outline the reasoning behind this third camp and outline your thoughts on this logic.?


2. Two tiers of government areusuallyy created to insure checks and balances agains the  centralisation of power. They are universally deemed as protector of democratic values. My only concern on co-governance is that there seems to be an  absence of explanation of what checks and balance will come with cogovernance. Can you elaborate or comment on what checks and balances co governance will have so we dont end up with system like Tonga where the King has excessive power or Fiji where the Reublic ultimately serve only the Paramount chiefs and mining companies.

3. The Union of Civil Liberties has written to the government on three seperate occassion asking the government of Key then Ardern to comment on the 2010 Constitutional Panel and recieved no reply in contrast to due process which requires a response.

This silence couppled with the absence of comment regarding the future status of our English statues ( Article 29 ‘Habeus Corpus & Bill of Rights 1688) and as Mirma Broughton of the Maori Law Review notes absence of comment of how power is shared not just with Rangatira but also with the Whanau and Hapu — whose status is covered in the 1835 Declaration — seems to lockstep with the CPTPP (TPPA) ISSD clauses, the Maori Land Court reforms and the proposed declaration of inconsistancy, to  centralise power in a manner which undermines individual rights and empowers corporate power.

How do we

A. Prevent this happening.?

B. Permit Co-Governance to become an opportunity to further empower our unique constitutional mechanics as a tool of truth and reconcillation that benefit both parties.

The ‘third group’ are best represented by Dominic O’Sullivan and Anne Salmond. You could follow up by trying to get interviews with them.  Salmond’s argument is that Te Tiriti was between the Crown and iwi/hapū, not ‘a partnership between peoples’. The idea of  ‘a partnership between peoples’ rests on a colonial or 19th century concept of ‘race’.  For example, Te Pati Māori want to make it compulsory for everyone who acknowledges Māori descent to be on the Māori electoral roll.  While this idea of ‘race’ does still underpin the choice whether or not a person of Māori descent goes on the Maori or general roll, those who champion major constitutional change seem to want it to underpin our entire constitution by installing co-governance at the highest levels.  So we might have a separate Māori parliament voted for by everyone of Māori descent.

By contrast, the rangatiratanga principle simply means that iwi and hapu should be able to govern their own internal affairs. O’Sullivan and Salmon argue this is where we should be making more space for them.

Those who seek major constitutional change think that one can apply federal principles across two different ‘peoples’ in the same space or territory. That is simply unworkable. Examples like Scottish devolution ignore the fact that if you live in Scotland you are subject to Scottish law, regardless of what ‘people’ you might be descended from.

A second tier of government representing Māori on an iwi or hapū basis is another alternative. It raises questions about what powers it would have. Assuming Māori continued to vote at parliamentary elections, many would see this as ’double-dipping’, unless its powers were limited.  And if they were, what would be the added value?

The New Zealand Council of Civil Liberties request for a response did not address Te Tiriti issues in what I could find about what they were asking for. As the 2010 Constitutional Review didn’t come up with much, presumably neither the Key or Ardern governments thought they was much they could say.  One of the big issues in that debate was recognising property rights in the Bill of Rights Act – not necessarily a good idea.

Mira Broughton advocates a tikanga-based constitution which I don’t believe was mandated by Te Tiriti.  If you read the 1835 Declaration of Independence, it explicitly claims kawanatanga – the power to make law – for the Māori Chiefs.  In Te Tiriti, they assign kawanatanga to the Crown in perpetuity, subject to retaining rangatiratanga – trusteeship (Hugh Kawharu’s translation) over their people and property.

That said, recognition of tikanga in matters internal to Māori is something that is for them to figure out within the framework of the legal system.

The idea of a constitution that more explicitly defines how power is shared is attractive to some – from the Geoffrey Palmers to the Moana Jacksons. However we already do have a constitution that shares power very widely because it is based upon the principle of popular sovereignty. The main role of constitutions is to limit popular sovereignty and allocate power to people that they otherwise wouldn’t have. Sometimes that it is a good thing, sometimes not.  But elites are better at negotiating their interests within institutions. Constitutions mean more lawyers are needed and money buys them. The thing about constitutions is that the devil is in the detail, and you can end up with judges interpreting them in ways that weren’t originally intended.

We do have too much centralised power in this country but that’s because local government has been hollowed out and crippled.  That is where iwi and hapū can have more influence and that is already happening (and will continue with or without Māori wards). Of which I’m strongly in favour.
